On and off the record: Judicial review for error of law
Identifying an error of law is often thought to be more straightforward than identifying jurisdictional error. But how do you show an error of law? What documents can you rely on as revealing an error of law on the face of the record in judicial review proceedings? What does s 69 of the Supreme Court Act mean when it refers to the “reasons” of a “court or tribunal” for “its ultimate determination”?
